VIOLATIONS

Dismissal

Also known as: ticket dismissed, violation dismissed, thrown out

What is a Dismissal?

A dismissal is a hearing outcome where the adjudicator finds the respondent not guilty and the violation is thrown out entirely. No fine is owed, any accrued penalties are voided, and the violation is marked as resolved. Dismissals are the best possible outcome when contesting a ticket.

Common grounds for dismissal include: defective ticket (wrong plate number, missing information), missing or incorrect signage, evidence of legal parking (photos, receipts), and procedural errors by the issuing officer. NYC's overall dismissal rate for parking tickets is approximately 30–40% for tickets that are actually contested, though rates vary significantly by violation code.

For fleet operators, knowing which violations are worth contesting is key. Some violation codes (like confusing no-parking zones or malfunctioning meters) have much higher dismissal rates than others (like hydrant violations with photo evidence). Clear Plates analyzes your violations against historical dismissal rates to help you prioritize which tickets to contest for maximum return on the time invested.
