What is a Hearing Default?
A hearing default is a guilty finding entered automatically when a respondent fails to appear at a scheduled hearing or fails to submit a timely response to a violation. Defaults are one of the most costly outcomes in NYC's violation system because they trigger maximum penalties with no opportunity to present a defense.
For DOF parking and camera violations, a default means the full fine plus all accrued penalties are confirmed, and the violation proceeds directly to civil judgment. For OATH violations, defaults are even more severe — the default penalty can be up to 5 times the original fine. A $350 idling violation that goes to default becomes $1,750.
