What is a Default?
Default is a violation status triggered when the respondent fails to respond to a ticket or fails to appear at a scheduled hearing. Defaulting on a violation is one of the most costly mistakes a fleet operator can make — it typically results in the maximum penalty being applied and the violation moving directly to judgment.
For DOF violations, default means the violation proceeds through all penalty stages immediately and enters civil judgment. For OATH violations, the consequences are even more severe: a default can result in penalties of up to 5x the original fine. A $350 idling violation can become $1,750 in default penalties. OATH default judgments can sometimes be vacated if the respondent demonstrates a valid reason for missing the hearing, but this requires a separate motion.
