Stipulation
Also known as: settlement agreement, negotiated resolution, stipulated agreement
What is a Stipulation?
A stipulation is a negotiated settlement agreement between the respondent and the city to resolve a violation without a full hearing or trial. In the OATH system, stipulations allow respondents to agree to certain terms — typically an admission of liability in exchange for a reduced penalty — avoiding the risk and time of a full hearing.
Stipulations are particularly common for OATH/ECB violations where the penalty range is wide. For example, an idling violation with a $350 first-offense fine might be settled via stipulation for a lower amount if the respondent agrees to corrective action (such as installing anti-idling technology). The stipulation terms become a binding agreement, and failure to comply can result in additional enforcement action.
For fleet operators, stipulations can be a strategic tool — accepting partial responsibility in exchange for meaningful fine reductions, especially on violations where the evidence is mixed or the full penalty would be disproportionate. However, stipulations require timely negotiation and proper legal documentation. Clear Plates tracks stipulation outcomes alongside other dispositions so you can evaluate whether negotiated settlements are delivering better results than contested hearings for specific violation types.
